Scope of activities of the Agent
- The main task of the Agent is to protect the interest of the Republic of Lithuania at the European Court of Human Rights. It is also within the competence of the Agent to prepare the information and applications necessary for communications submitted to the UN Human Rights Council under the International Covenant on Civil and Political Rights of 1966.
- The Agent prepares material and arguments, submits documents necessary for the investigation of applications lodged against the Republic of Lithuania before the European Court of Human Rights; represents the State in public hearings in the cases against Lithuania at the European Court of Human Rights; negotiates friendly settlements on behalf of the Government of the Republic of Lithuania; submits written observations and takes part at the Court’s hearings upon intervention of the Republic of Lithuania in the proceedings before the European Court of Human Rights as a third party by common consent of Ministry of Justice and Ministry of Foreign Affairs.
- The Agent takes part in notifying and disseminating the European Court’s case-law – the judgments of the Court in cases against Lithuania are published on the internet site of the Ministry of Justice; the collections of the Court’s judgments and decisions in cases against Lithuania, in Lithuanian language, are constantly published, relevant national institutions are informed of the decisions in cases against Lithuania, as well as of the new cases communicated to the Government.
- The Agent in cooperation with the Ministry of Justice and other relevant institutions coordinates the execution of the judgments of the European Court of Human Rights where the violations of the Convention were found – payment of the adjudged just satisfaction as well as costs and expenses; other general and individual measures imposed seeking to discontinue the violations found and to provide possible redress for their consequences or to prevent similar violations (for example, amending or adopting certain domestic legal acts, improving conditions in detention facilities etc.). The Agent constantly submits information concerning execution of the judgments of the Court in cases against Lithuania to the Committee of Ministers of the Council of Europe which supervises the execution of judgments as provided for in Article 46 of the Convention.
- The Agent also takes part when assessing compatibility of laws and other legal acts of the Republic of Lithuania to the provisions of the Convention.
- Every year until 1 March the Agent submits a report on last year’s performance of his/her tasks and functions to the Government of the Republic of Lithuania.
